A Minute of Agreement (or separation agreement) is a procedure by which two or more parties can decide on the details of their separation without going to court. In Scotland, it must be registered in the Books of Council and Session for it to be enforceable.  It can be used by cohabiting couples who are separating, or married couples who wish to separate but who don’t want to divorce.
